By downloading, installing, or using the App, you represent that you are at least 13 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the Parichay mobile application ("App") provided by AZAPI.ai ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you represent that you are at least 13 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
Parichay is a mobile application that enables users to:
- Scan physical business cards using their device camera
- Extract contact information using Optical Character Recognition (OCR) technology
- Save extracted contact details to the App's database and/or the user's device Contacts
- Initiate calls, emails, and WhatsApp messages to saved contacts via the device's native applications
3. License to Use
Subject to your compliance with these Terms, AZAPI.ai grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for your personal or internal business purposes on a device you own or control.
You may NOT:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App for any unlawful purpose or in violation of any regulations
- Use automated tools to scrape, extract, or aggregate data from the App
- Attempt to gain unauthorized access to any servers or systems used by the App
4. User Responsibilities
You agree to use the App responsibly and in compliance with all applicable laws, including but not limited to:
- Obtaining consent from individuals before scanning their business cards if required by applicable law in your jurisdiction
- Not using scanned contact data for spam, unsolicited communications, or any form of harassment
- Keeping your account credentials (if applicable) secure and confidential
- Promptly notifying us of any unauthorized use of your account
5. Camera and Contacts Permission
By granting camera permission, you authorize the App to capture images solely for the purpose of scanning business cards. By granting Contacts (Write) permission, you authorize the App to save contact details to your phone's native Contacts app. These permissions are entirely optional — the App will still function without them, though certain features may be limited.
You acknowledge that:
- The App does NOT read your existing contacts
- Calls, emails, and WhatsApp messages are initiated through your device's native apps — the App does not independently place calls or send messages
6. Accuracy of OCR Extraction
OCR technology may not always produce 100% accurate results. Extracted text may contain errors depending on card quality, font type, language, lighting conditions, and image resolution. You are responsible for verifying and correcting extracted information before saving or using it. We make no warranty that the OCR extraction will be error-free, complete, or suitable for any particular purpose.
7. Intellectual Property
All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of AZAPI.ai or its licensors and are protected by applicable intellectual property laws. You retain all rights to the business card data you scan. By using the App, you grant us a limited, non-exclusive license to process and store your data solely for the purpose of providing the service.
8. Third-Party Services and Links
The App integrates with or links to third-party services (e.g., WhatsApp, phone dialer, email client, Google services). We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. We encourage you to review their terms and policies.
9. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Guarantees that the App will be uninterrupted, error-free, or free of viruses
- Accuracy, reliability, or completeness of any information obtained through the App
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AZAPI.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, business, profits, or revenue
- Damage resulting from unauthorized access to or alteration of your data
- Any errors in OCR-extracted contact information
- Interruption or cessation of the App's functionality
BY USING THE APP, YOU EXPRESSLY AGREE THAT AZAPI.AI SHALL BEAR NO FINANCIAL LIABILITY OF ANY KIND TOWARD YOU. NO CLAIM, LAWSUIT, OR LEGAL PROCEEDING MAY BE BROUGHT AGAINST AZAPI.AI FOR DAMAGES — WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE — ARISING FROM YOUR USE OF THE APP. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH ANY CLAIM IS BASED AND EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, WHERE SUCH LIMITATION IS NOT PERMITTED BY APPLICABLE LAW.
11. Indemnification
You agree to indemnify, defend, and hold harmless AZAPI.ai and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your violation of applicable law.
12. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App immediately ceases. You may terminate your use at any time by uninstalling the App and deleting your account (if applicable).
13. Modifications to the App or Terms
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time. We may also update these Terms at any time. Material changes will be communicated via in-app notification or by updating the effective date. Continued use of the App after changes constitutes acceptance.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the courts of [Your Jurisdiction], as applicable.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements and understandings.
